PURPOSE: These Terms & Conditions outline the rules for using, viewing, and purchasing services or products on the Site.

By using this Site, including purchasing or downloading from our Site, Services, and/or Products, you implicitly agree to abide by these Terms & Conditions and our Privacy Policy. 2. Booking and Payment:

To book a Cinestar Experience, you must select a time slot and make a purchase through our online platform. Payment must be made in full at the time of booking.

Prices for our Products and Services can be found on our website. CINESTAR INC., reserves the right to alter the prices of any Service or Product at any time without notice. If you have any coupon codes, you can apply them during your checkout. Each coupon has its own terms of usage and usually they can be redeemed only once. We reserve the right to withdraw any coupons, promotional offers or discounts without notice. We can refuse or cancel any booking at our discretion.

When you pay for a Service and/or Product by credit card, you authorize and CINESTAR INC. to charge your credit or debit card for the amount owed for payment of the Service and/or Product. When you purchase the Service and/or Product, your information (i.e. credit card and contact info) may be collected by the third-party merchant (payment processor) like Stripe, Google Pay, etc (depending on the payment method you choose at checkout), who may have privacy policies or security practices that are different than ours. CINESTAR INC. is not responsible for the merchant’s independent policies or practices. You will receive an electronic receipt following your Purchase, which you should retain for your records. Please note that we will not be held accountable for any foreign transaction fees charged by your bank You hereby release us from any and all damages related to your payment or use of our payment processing companies in that you incur and further agree not to assert any claims against us or them for any damages which arise from your Purchase or use of our Site and its Content.

3.1. Cancellation & Rescheduling Policy:

Cancellations and rescheduling requests must be made within the time frame specified on our website or as communicated during the booking process. We reserve the right to cancel or reschedule the Cinestar Experience due to unforeseen circumstances, including but not limited to inclement weather or technical issues.

3.2. Refunds:

If you requested a cancellation, the refund, if any, and refund amount will be processed according to the cancellation policy as specified on our website or as communicated during the booking process.

If circumstances within its control prevent CINESTAR INC. from providing a Service, and rescheduling is not feasible for you, you are entitled to receive a full or partial refund of the Product/Service price.

CINESTAR INC will not be considered in violation of these terms and conditions, nor will it be held accountable, for any delay or failure to deliver Services if such instances are caused by events, circumstances, or factors beyond its reasonable control.

Refunds take up to 5 to 10 days to appear on the customer’s statement.

4. Participant Responsibility & Conduct:

Our Service, Cinestar Experience, involves creating a short-themed movie with you as the star. We will meet you at a designated location as agreed upon during the booking process. CINESTAR INC., is allowed to change the meeting location or Service location according to circumstances, in which case you will be informed at the earliest possible. The content, duration, and theme of the movie will be determined based on the package you have selected. By participating in the Cinestar Experience, you agree to cooperate with our team and follow their instructions. You are responsible for providing accurate information during the booking process, including any guests, preferences or special requests. If you are late for your booking, We can not guarantee to deliver the Service or any part of it, and we are not responsible or obligated to reschedule or refund the booking.

Customer Conduct: CINESTAR INC. reserves the right to require any individual to leave our services if their behavior is deemed offensive, disruptive to Us or other customers, or poses a safety risk to themselves or others. In such instances, CINESTAR INC. assumes no further liability. We prioritize the safety and comfort of all participants and employees.

Non-Defamatory Statements: Participants of CINESTAR INC.'s services agree not to engage in any activities, online or offline, that could be construed as defamatory towards CINESTAR INC., its employees, partners, or other users. This includes but is not limited to making false statements, spreading rumors, or engaging in any other form of communication that may harm the reputation or integrity of CINESTAR INC. Any violation of this clause may result in legal action.

5. Media Release:

By purchasing and participating in our Services, you agree to grant us the right to use any photographs, video recordings, or other media taken of you during the provision of our service for marketing, promotional, and advertising purposes, online and offline. You acknowledge and agree that we may use such materials without any further notification or compensation to you and that you waive any right to inspect or approve the materials. If you do not wish to grant this permission, please notify us in writing prior to your purchase.

6. Testimonial and Your License to Us:

We love to share your comments, feedback, wins, reviews and successes. By signing up or booking our Products and/or Services, you grant us the right, title and interest to share any and all communications, comments, screenshots of communications, reviews and/or testimonials in connection with Your participation in the Product or Service for the purposes of promoting and marketing the Product or Service across social media, advertisements, our website, any other distribution media and to our future customers. You understand that you will not receive any compensation for use of your testimonial, or image. In addition, You waive any right to inspect or approve the finished product, including written copy or edited video wherein your likeness or your testimonial appears.

8. DISCLAIMER - No Warranties, Guarantees, or Representations Are Being Made:

Any testimonials, reviews, statements, or examples provided by us are for illustrative purposes only. We make no guarantees that you will achieve similar results or experience by participating in our Services. Every customer's circumstances are unique, and individual results may vary. We do not provide any warranties, guarantees, or representations regarding the Site, Services, and/or Products. They are provided on an "AS IS" basis without any express or implied warranties, to the extent permitted by law.

9. Intellectual Property Ownership & Copyright:

The Site and its Content, Products and Services, including those with the absence of a registered copyright symbol, are intellectual property solely owned by CINESTAR INC. and are protected by United States copyright and trademark laws, as well as state intellectual property laws.

Upon purchase and participation in the Services, you are granted a non-exclusive, royalty-free, perpetual, worldwide license to use, share, and display the video content produced as part of these Services. This license is non-transferable and does not permit sublicensing. Any violations of this term, and all terms contained herein, will be legally pursued to the fullest extent permitted by law.

10. User Generated Content:

Any content you upload and share on social media in regards to our Products and Services and your participation in them, will be considered non-confidential and non-proprietary. You retain all of your ownership rights to your content but grant Us a limited license to use, save and share your content. CINESTAR INC. is therefore granted a lasting, global, non-exclusive, royalty-free, transferable permission to use, copy, share, create new versions of, and show your content related to the Services on various platforms and media.

10. Purchase, Access Terms and Sharing the Site & Its Content:

You must request and receive written permission by email before sharing our Site and its Content for commercial purposes. 13. ARBITRATION CLAUSE:

By agreeing to this term, you hereby agree and understand that you’re waiving your right to a jury trial in court, which would otherwise be available to you if not for this Arbitration Clause. Should any arbitration hearing need to be held, it shall be held within New York City.

If the arbitrator issues an award and a judgment is made, the judgment will be binding and will be entered in court in the State of New York. The only award that can be issued to you is a refund of any payment made to CineStar Experience for the applicable Product or Service. You are not permitted to seek additional damages, including consequential or punitive damages.

14. Consent to Governing Law:

These Terms & Conditions, and any dispute arising out of it, shall be governed by the laws of the State of New York.

15. Consent to Jurisdiction:

You hereby irrevocably consent to the exclusive jurisdiction and venue of any Federal Court in the United States District Court for the District of New York or a state court located within the State of New York in connection with any matter arising out of these Terms & Conditions, Privacy Policy and/or Disclaimer, or as a result of your use, Download, or Purchase from the Site, Services, and/or Products.

By consenting, you affirm that legal documents may be served to you in accordance with the laws of the State of New York for individuals in such circumstances, and you waive any potential objections to the method of service under New York State law.
